Personal Data That You Provide Through the Services
We collect Personal Data (such as name, email address, phone number, address (city, state, zip), and other health-related information) from you when you voluntarily provide such information by taking advantage of certain functionalities on our website, such as “Find a CORUS Surgeon”, or “Contact Us”. Data Collected Automatically through Your Use of the Services
When you interact with the Services, we and third parties automatically collect certain information using various technologies about your interactions with the Services, such as your Internet Protocol (IP) address, approximate location based on IP address, user settings, IMEI, MAC address, cookie identifiers, mobile carrier, mobile device type, details about your browser, operating system or device, or other unique identifiers, including through cookies, pixels, and other tracking technologies (“Tracking Technologies”).
A cookie is a piece of information that the computer that hosts our Services gives to your browser when you access the Services. A “pixel tag” (also known as a “web beacon”), is a piece of code embedded within a website, email, or application that collects information about users’ engagement. This information is collected and used to tailor your experience with the Services, run analytics, better understand user interactions with the Services, and target, deliver and measure interest-based advertising. Services Via Mobile Devices
PMT provides Services that are specifically designed to be compatible and used on mobile devices. PMT will collect certain information that your mobile device sends when you use such Services, like a device identifier, user settings, approximate location information based on IP address, mobile carrier, and the operating system of your device only to the extent necessary to provide the Service via your mobile device. PMT may enable individuals to download an application, widget, or other tools that can be used on mobile or other computing devices. Some of these tools may store information on mobile or other devices and may enable individuals to access the Services.
PMT uses Personal Data for a variety of reasonable business purposes consistent with applicable law and this Privacy Policy, or as otherwise communicated to you at the point of collection, such as to:

Investigation of Product Complaints
PMT and the Services are wholly owned and operated by Providence Medical Technology, Inc. (“PMT”), a privately-held medical device company with an office located at 3875 Hopyard Road, Suite 300, Pleasanton, CA 94588.
PMT is obligated by the Food and Drug Administration (“FDA”) to report and investigate complaints regarding PMT products. PMT may investigate complaints regarding PMT products provided via the Services as required by the FDA. If you submit a complaint via the Services, PMT may use your Personal Data as part of its investigation.
Research and Development
PMT may use Personal Data, alone or with information obtained from other sources, in order to help us to optimally deliver our existing Services or develop new Services. We may perform research (online and offline) via surveys or otherwise within specific, opt-in areas of the Services. All survey responses are voluntary, and the information collected will be used for research and reporting purposes to help us better serve individuals by learning more about their needs and the quality of the Services we provide. The survey responses may be utilized to determine the effectiveness of our Services. If an individual participates in a survey, the information given will be used along with that of other study participants.
Other Uses
PMT may use Personal Data where you have consented, where using Personal Data is part of a contract of which PMT is a party, or for purposes for which we have a legitimate interest, such as individual or market research, anti-fraud protection, or any other purpose disclosed to you, including through this Privacy Policy, at the time you provide Personal Data or with your consent.

Your Account Profile
Any Personal Data included in your account profile will be available to other users. Your contact information will not be included in your profile unless you choose to include it. You can edit the information available in your profile.
Business Transfers
As we develop our business, we may sell or buy businesses or assets. In the event of a corporate sale, merger, acquisition, reorganization, dissolution, or similar event, Personal Data may be disclosed in anticipation of or as part of the transaction. In such an event, PMT will take commercially reasonable steps to direct the transferee to use Personal Data in a manner that is consistent with the Privacy Policy applicable to your Personal Data.
Vendors and Third Parties
PMT, like many businesses, sometimes hires other companies to perform certain business-related functions and we may disclose any Personal Data we collect to our third-party service providers for the purpose of maintaining and/or improving the Services or for the performance of any contract we enter into with them or with you. Examples of such functions include data storage and cloud services, security, analytics, marketing and advertising, and the deployment of Tracking Technologies.
Professional Advisors
PMT may share Personal Data with professional advisors, such as auditors, law firms, or accounting firms.
Required Disclosures
We may access, preserve, and disclose Personal Data, other account information, and content if we believe doing so is required or appropriate to: (i) enforce or apply the Terms of Service or Privacy Policy; (ii) respond to your requests; (iii) comply with laws, subpoenas, warrants, court orders, legal processes or requests of government or law enforcement officials; (iv) protect our rights, safety or property, or that of our users or others; (v) protect against legal liability; (vi) establish or exercise our rights to defend against legal claims; (vii) investigate, prevent or take action regarding known or suspected illegal activities or fraud; or (viii) as we otherwise in good faith believe is otherwise necessary or advisable.
As noted above, PMT may also disclose personal information as required by the FDA in connection with reporting and investigating complaints regarding PMT products.
Selling and Sharing
While we do not sell Personal Data in the traditional sense, we disclose (and have disclosed in the preceding 12 months) the following categories of Personal Data for cross-context behavioral advertising purposes with providers of Tracking Technologies in a manner that may be considered “targeted advertising”, “selling” or “sharing” as those terms are defined under applicable law: identifiers, Internet or similar network activity, geolocation information (such as IP address) and inferences drawn from other personal information. However, we have no actual knowledge that we have “sold” or “shared” the personal information of individuals under 16 years of age.
Direct Marketing
PMT does not disclose your personal information to third parties for the third parties’ direct marketing purposes, unless you have affirmatively agreed to such disclosure.
PMT stores and processes data received via the Services in the United States. If you access the Services from outside the United States, the information you provide to the Services will be transferred to the United States for storage and/or processing. By choosing to utilize the Services or otherwise provide information to us, you agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the laws of the United States, and the adjudication of any disputes arising in connection with the Services will be in accordance with the Terms of Service, available at www.providencemt.com/terms.
The Services are intended only for users located in the United States. If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your information to the United States and to processing of your data globally. By providing your Personal Data, you consent to any transfer and processing in accordance with this Privacy Policy.
You agree that all Personal Data collected via or by PMT may be transferred, processed, and/or stored in the United States in the cloud, on our servers, or on the servers of our service providers. By providing information to PMT, you explicitly consent to the storage of your Personal Data in these locations.
While we take precautions designed to protect your Personal Data, not all data transmission over the internet may be secure, and PMT cannot guarantee its security.
As described above, third parties and we use Tracking Technologies to collect certain information about your interactions with the Services. Most browsers accept Tracking Technologies automatically, but you may be able to control the way in which your devices permit the use of certain Tracking Technologies. If you choose, you may block or delete certain Tracking Technologies from your browser; however, blocking or deleting cookies may cause some of the Services to work incorrectly.
Your browser settings may allow you to transmit a signal or other mechanism for exercising your choice regarding the collection or processing of your information when you visit various websites.
Our website recognizes the Global Privacy Control (GPC) signal, which enables you to opt-out of certain uses or disclosures of your Personal Data. If you notify us of your preference through GPC, we will honor your request only for the browser or device that sends the GPC signal.
You may also opt-out of the collection and use of Personal Data for interest-based advertising by advertisers that are part of certain industry alliances, including through tools offered by the National Advertising Initiative, the Digital Advertising Alliance or the European Interactive Digital Advertising Alliance, by clicking the links provided.
Depending on where you live, you may have certain rights in relation to your Personal Data. However, please note that a number of these rights only apply in certain circumstances, and all of these rights may be limited by law.
Submitting a Request

We will not retaliate or discriminate against you for exercising any of these rights. To protect your privacy, PMT will take commercially reasonable steps to verify your identity before accepting your request. You may designate, in writing or through a power of attorney document, an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us.
Opt-Out of Email Communications and Push Notifications
If you receive a marketing email from us, you may opt out at any time using the unsubscribe / opt-out instructions provided in our communications to you or reply to the email requesting to opt out of receiving future marketing emails. We will process your request within a reasonable time after receipt and in accordance with applicable law. We may also send you certain non-promotional communications regarding the Services, and you will not be able to opt out of those communications (e.g., communications regarding updates to our Terms or this Privacy Policy).
If you use the Services via a mobile application, we may occasionally send you push notifications through the mobile application with notices that may be of interest to you. You may at any time opt out from receiving these types of communications by removing the mobile application from your mobile device or changing the push notification settings on your mobile device.
Rights of California Residents
California law permits users who are California residents to request and obtain from us, once a year, free of charge, a list of the third parties to whom we have disclosed their Personal Data (if any), for their direct marketing purposes, in the prior calendar year, as well as the type of Personal Data disclosed to those parties. PMT does not share Personal Data with third parties for the third parties’ own marketing purposes.
Rights of EU Residents
a) The right to require PMT to confirm whether or not their information is being processed, the purpose of any such processing, the recipients of any information that has been disclosed, the period for which their information is to be stored and whether any automated decision-making processes are used in relation to their information;
b) The right to require PMT to rectify inaccurate information without undue delay;
c) The right to request the erasure of their information. Subject to certain conditions, PMT may be required to erase the information in response to such request where:
a. the information is no longer necessary in relation to the purpose for which it was collected, such as where a user chooses to terminate his or her use of the Services;
b. where the processing of the information is based on the user’s consent (and the other circumstances described in the ‘Our Use of Personal Data and Other Information’ and ‘Our Disclosure of Personal Data and Other Information’ sections above no longer apply), if the user withdraws his or her consent; or
c. the user objects to the processing of his or her information and there are no overriding legitimate grounds for the processing.
d) Where PMT has disclosed the information of a European Union user to a third party and the user requests the erasure or rectification of the data, PMT will take all reasonable steps to inform the third party of such request.
e) The right to restrict PMT from processing their information in certain circumstances, such as where the accuracy of that information is disputed or an objection has been raised (see below). In such circumstances, PMT will only process that information with the express consent of the user, or for the establishment, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest;
f) The right to receive their information from PMT in a structured, commonly used and machine-readable format;
g) The right to object to the processing of their information by PMT where: PMT has relied on the ‘legitimate interest’ basis for processing that information, in which case we will immediately stop processing the user’s information unless we have compelling legitimate grounds which override the interests, rights, and freedoms of the user; or the information is used for direct marketing purposes, in which case we will immediately stop processing the user’s information for such purposes.

The above legal rights of EU residents are subject to various conditions and exceptions, including where the data is used for statistical or scientific research purposes and the exercise of the right would prevent such purposes from being attained or would seriously impair their attainment.
This section applies to you if you are a resident of California and we process personal information about you that is subject to the California Consumer Privacy Act (“CCPA”). For purposes of this section, references to Personal Data and Sensitive Personal Data shall include “personal information” and “sensitive personal information” as defined under the CCPA.
Processing of Personal Information
In the preceding 12 months, we collected and disclosed to service providers (as described in the Our Disclosure of Personal Data and Other Information section above) the following categories of Personal Data and Sensitive Personal Data (denoted by *):

We only use and disclose Sensitive Personal Data for purposes specified in the CCPA or otherwise in line with your consent, and we do not use or disclose Sensitive Personal Data for purposes of inferring characteristics about you. Our Services are not directed to children under 13 (or other age as required by local law), and we do not knowingly seek or collect Personal Data from children. In addition, you are not permitted to use our Services if you do not meet the minimum age requirement applicable to our Services in your jurisdiction, which is not less than 18 years of age. If we learn that we have collected any Personal Data about a child in violation of applicable laws, we will promptly take steps to delete such information and terminate the child’s account. If you are the parent or guardian of a child under 13 years of age who has provided us with their Personal Data, you may contact us using the below information to request that it be deleted.
PMT does not intentionally collect Protected Health Information as defined by the Health Insurance Portability and Accountability Act of 1996, its amendments and the rules promulgated thereunder (“HIPAA”), personally identifiable information of patients, or other patient information.
